1. Introduction:

a) The domain name www.bhaktiaadiveda.com(“Website”), including its online services, such as use of software on Website and information, articles , news, blogs and text, graphics, images and information obtained from service providers and any other material contained on the Website is owned and operated by Bhakti Aadiveda Ayurvedic Company,having its registered office Village-Navipur Kheriya ,Post –Kaser kalan ,District- Bhulandshahr ,U.p-203393

b) This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as Applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by an Platform and does not require any physical or digital signatures.

c) This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of Platform.

d) For the purpose of these Terms of Use, wherever the context so requires “You” or “Customer” shall mean any natural or legal person who uses the Platform. BAVAC.allows the User to surf the Platform with registering on the Platform. The term “We”, “Us”, “Our” shall mean BAVAC.

e) Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. Use of the Platform shall subject to the policies that are applicable to the Platform. By mere use of the Platform, You shall be contracting with BAVAC.and these terms and conditions including the policies constitute Your binding obligations, with BAVAC.

f) This Platform, including all Materials present (excluding any applicable third party materials), is the property of BAVAC and is copyrighted and protected by worldwide copyright laws and treaty provisions. You hereby agree to comply with all copyright laws worldwide in Your use of this Platform and to prevent any unauthorized copying of the Materials. BAVAC does not grant any express or implied rights under any patents, trademarks, copyrights or trade secret information.

2. Customer Eligibility:

The customer should check and comply with the provisions related to Indian Contract Act, 1872 to become the registered customer on the PLATFORM.

3. Registration Obligation:

Customer should get registered on the PLATFORM and for registration he should follow the instructions as visible on the Platform at the time of registration.

4. Communication:

When You use the PLATFORM or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

5.Posting On Platform:

The right to post anything on Platform is the legal right of BAVAC only. If any third party knowingly or unknowingly breaching of this term then BAVAC will have the right to take the legal action as per the prevailing laws of land.

6. Facilities To Be Rendered By The Website:

i. Bhakti Aadiveda is a platform where customers have an access to relevant information pertaining to their choices of Ayurvedic Products & Medicine in the form of Tablets,Capsules,Juice, Health tonic, Syrup, Oil, Gel, Powder, Churna and Cosmetic with more than 100 products covering all health problems likes Leucorrhoea,BloodPressure,Heart Care, Diabetic Care, General Care, Critical Care, Men’s Care, Women’s Care, Child Care, Immunity Care, Oral Care, Hair Care, Personal care and their use through Comapany’s assistance.

ii. The user Account on the Website through logging in by their third party website user ID and password including that of www.facebook.com, websites owned by Yahoo Inc. or its subsidiaries, Google Inc. or its subsidiaries, twitter or any other social media website or any other Internet service as permitted on the Website (User ID and/or other third party login identification as provided above are individually and collectively referred to the “Account Information”).

iii. Bhakti Aadiveda provides natural Ayurveda and Herbal products to the User. The Color of the Products might change due to seasonal variations. All the bottled packaging for the Ayurveda and Herbal Products are BPA free. Though Bhakti Aadiveda does not make any representations or warranties regarding specifics (such as quality, value, and salability) of the items or services proposed to be sold, offered to be sold or purchased on the Website.

iv. By using this Website, and providing his/her contact information to the Company through the Website, the User hereby agrees and consents to receiving calls, auto dialled and/or pre-recorded message calls, e-mails and SMSs from the Company and/or any of its affiliates or partners at any time, subject to the Policy. In the event that the User wishes to stop receiving any such marketing or promotional calls / email messages / text messages, the User may send an e-mail to the effect to consumer@bhaktiaadiveda.com The User agrees and acknowledges that it may take up to seven (7) business days for the Company to give effect to such a request by the User.

The User expressly agrees that notwithstanding anything contained hereinabove, he/she may be contacted by the Company or any of its affiliates / partners relating to any service availed of by the User on the Website or anything pursuant thereto. It is expressly agreed to by the Parties that any information shared by the User with the Company shall be governed by the Policy.

7. Charges and Payment:

a) Payments for the Services/Goods offered by Bhakti Aadiveda shall be made through payment gateway CC Avenue, Net Banking, Credit card, Debit card, UPI and other wallets.

 b) Bhakti Aadiveda offer no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Users card/bank accounts.

 c) GST on all the above components shall be charge separately.

d) Bhakti Aadiveda have a right to hold or reclaim the Payment in cases of abuse, fraud or violation of agreement.

However, the Company reserves the right to amend this fee policy for any or all services offered or sold. In such an event, the User will be intimated of the same when he/she attempts to access the Website, and the User shall have the option of declining to avail of the services offered on the Website. Any such change, if made, shall come into effect immediately upon such change being notified to the User, unless specified otherwise.

8. Limitation Of Damages:

In no event shall BAVAC or any of its subsidiaries or affiliates would be liable to any entity for any direct, indirect, special, consequential or other damages (including, without limitation, any lost profits, business interruption, loss of information or programs or other data on your information handling system) that are related to the use of, or the inability to use, the content, materials, and functions of this Platform or any linked Platform, even if BAVAC is expressly advised of the possibility of such damages.

9. Disclaimer:

The Platform may contain inaccuracies and typographical and clerical errors. BAVAC expressly disclaims any obligation(s) to update this Platform or any of the materials on this Platform. BAVAC does not warrant the accuracy or completeness of the Materials or the reliability of any advice, opinion, statement or other information displayed or distributed through the Platform. You acknowledge that any reliance on any such opinion, advice, statement, memorandum, or information shall be at your sole risk. BAVAC reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Platform. BAVAC may make any other changes to the Platform, the materials and the products, programs, services or prices (if any) described in the Platform at any time without notice. This Platform is for informational purposes and fulfilment of the purposes for which the Platform was developed by BAVAC only and should not be construed as technical advice of any manner

10. Applicable Law:

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bhulandhshahr (U.P).
